Not Reasonable

Immunity from redundancy selection

Is this considered a reasonable adjustment under UK Law?

Overview

Disabled staff are not immune to redundancy.

For Employees

You can't demand immunity. You CAN demand the selection criteria doesn't disadvantage you (e.g. absence records).

For Employers

Redundancy must be fair. You cannot simply "save" someone because they are disabled if they score lowest.

Key Considerations

  • Selection criteria adjustment.
  • Protected period (rare).
